When You Want to Change the Terms of Your Testamentary Trust: 3 ...

Tip 1: Be clear about the changes you want to make and why.

People often establish a testamentary trust to provide inheritances to those who cannot govern them themselves, such as minor children who cannot directly own property. If you want to change the terms of the trust you need to be sure why you are doing so and if changing the trust terms is the right course. You should speak to an attorney about this because there may be other alternatives you have not considered that could fit your desires better.

Tip 2: Consider the effect the change will have on your other property.

A significant change to the terms of your testamentary trust could impact the other gifts or conditions you included in your will. If, for example, you direct that additional property gets transferred to the trust, that property might affect the inheritances you directed in the will.

Tip 3: Make your changes in writing.

The most common way to update or alter the terms of a testamentary trust is to create a codicil or a new will. A codicil is a document that alters the terms of your existing will, while a new will allows you to completely rewrite it. Both documents must be printed and comply with the laws of your state. These laws are the same laws that applied when you made your original will, and failing to meet them will render the updated document invalid.

Four, No Five, Ways To Improve Your Public Speaking

A few years ago, a guy on my staff team observed, ?The two things we do the most in ministry ? leading small groups and public speaking ? are the two things for which we get the least amount of training.?

If, indeed, ?The tongue has the power of life and death,? it makes sense that we would do everything we can to learn how to wield that weapon effectively. It makes sense that part of our personal development must include developing as a public speaker. But how?? Let me share four things that have helped me.

1. Listen to great speakers.

Don?t just listen to their content, but listen to how they say what they say. Listen for how they structure their messages. Even better, watch great communicators.

2. Video record yourself speaking.

I know, ?Why would I want to watch myself speaking?? Don?t ask others to do what you yourself aren?t willing to do ? and that includes hearing you speak. Seriously, you will be your own worst critic. Others may forgive you for touching your nose constantly, but when you see yourself do it, it?s downright embarrassing. And you probably won?t ever do it again.

This is so easy to do, too. The next time you?re going to be speaking to a group, hand someone your phone and ask them to record you. Then, go watch yourself in the privacy of your own home and do a self-critique.

3. Ask several people in the audience to give you a ?three by three? evaluation.

Before you get up to speak, hand five people in the audience a 3?5 card. At the end of your talk, ask them to write down three things that you did well and three things that you could improve. I?ve found this is the only way to get balanced feedback. This forces people to actually give you something constructive as well as something positive.

4. Focus on improving delivery and not just content.

There is more to speaking than passing on content. How you say what you say is as important as what you say. Things like gestures, eye contact, movement, and voice matter.

It?s been said that any movement that does not add to your presentation takes away from it. Think about that: Poor delivery can negate good content. As you seek to develop good content, it?s just as important that you also develop good delivery skills.

Industry News: Xcel Race Against Skin Cancer Date Announced ...

(O?ahu, Hawai?i) ? Pre-registration continues for the Xcel Race Against Skin Cancer, presented by the University of Hawai?i Cancer Center (UHCC). The standup paddle sprint race, to be held along the iconic Waikiki shoreline, is scheduled for Saturday, February 9 and will benefit skin cancer awareness.

Competitors will compete on a short, 2.38-mile course from Kaimaina Beach to just beyond Duke Kahanamoku Beach. The quick race is designed to encourage paddlers of all skill levels to come out and support the cause.

The first-time event is the latest initiative in the ongoing partnership between Xcel and the UHCC to fight skin cancer in Hawai?i and beyond. All event proceeds benefit the UHCC, which celebrates its new world-class, 150,000 square foot Cancer Center grand opening in late February. The Hawai?i Skin Cancer Coalition will give free skin cancer screenings for all at the finish line.

Student gets dying wish from Reddit: Cryonic preservation

Kim Suozzi, a 23-year-old neuroscience student with terminal brain cancer, received her dying wish of cryonic preservation on Jan. 17 after a successful fundraising campaign launched on the internet.

Cryonic preservation freezes legally-dead people to liquid nitrogen temperature to stop physical decay. People undergo it in the hope that future technology will exist to revive their bodies and restore them to good health.?

Suozzi announced her desire for cryonic preservation on Reddit, a social media website, in August 2012 after learning she had less than a year to live.?

?I?ve been interested in cryonics since long before I was even diagnosed, but I never thought that I would have to secure the finances so fast, and without a career or savings to stand on,? she wrote.

The procedure runs anywhere between $28,000 and $200,000 depending on the options chosen, according to io9.?

Suozzi?s request was picked up by the Society for Venturism, a non-profit futurist group that advocates cryogenics.?

The combined fundraising efforts succeeded and Suozzi went into cryosuspension at the Alcor Life Extension Foundation in Scottsdale, Ariz., on Jan. 17, the society announced.

The likelihood of a?person coming back to life using current freezing techniques is nil, Arthur Caplan, director of the Center for Bioethics at the University of Pennsylvania, told NBC News, especially given the vulnerability of cells to frosting and defrosting.

?It wouldn?t take a lot of damage to shift somebody from being a reconstituted person to being a reconstituted vegetable,? he said. ?You don?t need that much cell damage to cause harm.?

Even if a person were successfully restored, ?you?re going to be kind of a freak,? Caplan added.?

For one, in century or two, a person is unlikely to harbor immunity to flu or other diseases of the time and could easily get sick and?die upon first contact. Caplan likened the effect to the devastating spread of disease among Native Americans upon first contact with Europeans.

?Socially you are facing trouble because you are going to be this weird object of curiosity,? Caplan added. ?Friends are gone. No one is there. I would worry you quickly become isolated and depressed.?

Despite the unlikelihood of success and weird reality a person would wake to if cryonic preservation did indeed work, Caplan said people will still likely spend hundreds of thousands of dollars giving it shot.

?I think it is a ripoff,? he said. ?The dream of immortality is powerful, but I think it?s just a pipe dream.?

Suozzi was aware of the controversy and doubts surrounding cryonic preservation, but pursued it nevertheless. ?It?s a better shot at living again than if I were decomposing somewhere or cooked into ash,? she wrote.?

Write or Acquire a Screenplay - Filmmaking Stuff

Screenwriting is the heavy lifting for your movie. Without a good script you limit your chances for success from the onset. Your goal is to only work with the best material you can get your hands on. You will want to decide if you will write your screenplay yourself, with a writing partner or if you will acquire a screenplay from someone else.

If you choose to write your screenplay yourself, do not be afraid to write a crappy first draft. Most screenwriters in Hollywood claim to have a screenplay, but that is not true. Rather most would-be screenwriters have the first 15 pages to screenplay and they will never finish. This is because they are afraid of failure. But not you. Your goal is to write, and write, and write. Finish a crappy first draft. Then refine it.

In the event you simply want to acquire good material, many filmmakers post an ad on craigslist.com whereby seeking a competent screenwriter. But if you do this I guarantee you will be inundated by gazillions of writers seeking a producer. I suggest that you research established but new screenwriters who have a similar vision. You may have to pay, but at least you will know the type of work you are getting.

Questions and answers about China and North Korea

BEIJING (AP) ? China took a step against longtime ally North Korea on Tuesday by voting in favor of a U.N. Security Council resolution condemning Pyongyang's long-range rocket launch in December. Beijing is concerned that North Korea's nuclear ambitions are destabilizing the region, but is willing to go only so far to punish its economically struggling neighbor. Here are some questions and answers about China's role:

WHY DOES CHINA SUPPORT NORTH KOREA?

Beijing fears a collapse of the North Korean regime could send a massive flow of desperate, starving refugees into northeastern China and lead to a pro-U.S. government setting up across its border. Chinese firms could lose their leading position in North Korea, while South Korean investment in China would be diverted to help rebuild the devastated North's economy.

WHAT ABOUT NORTH KOREA'S MISSILES AND NUCLEAR PROGRAM?

China wants a stable, peaceful Northeast Asia and doesn't want the North to provoke retaliation from the South, Japan or the United States. China calls for denuclearization of the Korean Peninsula, though Beijing's leaders are seen as resigned to the North possessing some sort of atomic weapon.

WHAT APPROACH DOES BEIJING RECOMMEND?

China typically calls for dialogue instead of sanctions, and has hosted successive rounds of talks also involving the two Koreas, Japan, Russia, and the U.S. Pyongyang agreed at the six-nation talks to end its nuclear programs, but discussions broke down over how to verify that.

SO WHY DID CHINA VOTE FOR THE NEW U.N. RESOLUTION?

China wants to register its displeasure with Pyongyang's missile launch and doesn't wish to be seen as obstructing the U.N.'s work. At the same time, it has pushed for a watered-down response, agreeing to strengthen existing sanctions while opposing substantially new ones. Beijing also wants to appear cooperative with the second Obama administration.

HOW MUCH INFLUENCE DOES BEIJING HAVE WITH PYONGYANG?

Hard to say. Chinese scholars and officials say not as much as the outside world thinks, and that sanctions have little effect on Pyongyang. That's despite China being the North's most important political ally, as well as its biggest source of food and fuel aid to prevent total economic collapse. China's overriding fear of the North becoming a failed state severely limits Beijing's options.

WHAT'S THE HISTORY BETWEEN THESE TWO?

Chinese troops fought on behalf of the North Korean regime in the 1950-53 Korean War and relations between the communist neighbors were long described as being "as close as lips and teeth."

Mother charged in twins' death in tragic fire

A Pittsburgh mother whose 3-year-old twins died in a fire -- after she left them home alone to hunt for stolen marijuana -- ?has been charged with involuntary manslaughter in the toddlers? deaths.

Dalawna Berran-Lett, 32, was also charged with endangering the welfare of children and reckless endangerment by Allegheny County Police after her two boys, Ky'heir and Dy'heir Arthur were killed in the Jan. 4 fire.

Police believe Berran-Lett left the boys unattended for at least 45 minutes while she tried to retrieve the bag of weed that had been stolen by her teenage daughter.

Investigators believe the twins started the fire trying to cook something.

It wasn't the first time the boys had used the stove ? or the first time pot was involved.

In late December, Berran-Lett came home to find smoke in the kitchen as the twins attempted to cook ribs, the Pittsburgh Tribune-Review reported. In that instance, police said she had left the children unattended for about 20 minutes while she went shopping -- for rolling papers to smoke marijuana.?

On Jan. 4, Berran-Lett told police she had left the boys watching television, according to the Pittsburgh Post-Gazette.

"It was too cold outside" to take them with her, she reportedly told police.

After locking the front door, she went looking for her daughter, Mariah, 15, who she believed had taken the marijuana from her purse. Police believe the woman left the house around 2:45 p.m.

While she was gone, investigators believe the boys turned on the stove, then, as the grease caught fire, the flames engulfed the wood-frame rental house.

The first call to the firefighters went out at 3:33 p.m., police said, from a contractor working on a neighboring house.

Berran-Lett returned to find her home on fire and surrounded by firefighters. Her daughter was also standing outside.

According to the Post-Gazette, one of the twins died of burns and smoke inhalation, while the other died of smoke inhalation and carbon monoxide poisoning.

Berran-Lett surrendered to police Tuesday afternoon. Her attorney, R. Blaine Jones II?told the Tribune-Review?the woman was distraught.?

"She is in the state of complete shock. She just buried her babies on Saturday,? Jones said.

Her daughter is currently staying with relatives, police said.

That brings them up to four large flow rooms, three hot yoga rooms and one Pilates room between the two centers. Relations between the United States and Venezuela have been strained ever since President Hugo Ch?vez took office in 1999.

However, in what could be seen as a thaw in the icy relations between the two countries, Venezuela is weighing a U.S. government request to let a high-level DEA official visit the South American country.

Venezuelan Ambassador to the Organization of American States Roy Chaderton told The Associated Press on Friday that his country's main consideration is ensuring mutual respect between the countries.

Obama says U.S. ready to assist Algerian officials

WASHINGTON (AP) ? President Barack Obama said Saturday the U.S. stands ready to provide whatever assistance Algerian officials need in the aftermath of the deadly terrorist attack at a natural gas complex in the Sahara.

The four-day standoff appeared to end Saturday after Algerian special forces stormed the complex. The clash left at least 23 hostages dead and killed all 32 militants involved, the Algerian government said.

The State Department issued a travel warning Saturday night for Americans in or traveling to Algeria, citing credible threats of the kidnapping of Western nationals. The department also authorized the departure from Algeria of staff members' families if they choose to leave.

In a statement from the White House, Obama said the blame lay with the militants and that the United States condemns their actions.

"This attack is another reminder of the threat posed by al-Qaida and other violent extremist groups in North Africa," Obama said. "In the coming days, we will remain in close touch with the government of Algeria to gain a fuller understanding of what took place so that we can work together to prevent tragedies like this in the future."

Earlier Saturday, during a news conference in London with Defense Secretary Leon Panetta, British Defense Minister Philip Hammond called the loss of life appalling and unacceptable.

"It is the terrorists that bear the sole responsibility," Hammond told reporters.

Hammond didn't criticize Algeria's handling of the attack directly, but he appeared to reference the increased concern from world leaders about the lack of transparency in Algeria's anti-terror operation.

"Different countries have different approaches to dealing with these things," he said. "But the nature of collaboration in confronting a global threat is that we work with people sometimes who do things somewhat different, slightly differently from the way we do them ourselves."

Panetta said that "those who would wantonly attack our country and our people will have no place to hide."

"Just as we cannot accept terrorism attacks against our cities, we cannot accept attacks against our citizens and our interests abroad," he said.

Netflix or Lovefilm Instant? Perhaps it's only the most content-hungry viewers that decide to sign up with both services, but for the rest of us, we'll only choose one -- but which one? Now Oric, a service that collates legal streaming services in the UK, has surveyed both catalogs and deemed that... it depends. For TV shows and series, Netflix can stream 412 TV titles (with 925 total series), while Lovefilm Instant can only offer up 300 titles and 589 seasons.

However, If you're wanting to pile on the movies, Amazon's UK streaming service then comes out on top, with 3,284 movies almost doubling Netflix's 1,668 titles. There's not much crossover here, either, with 3,015 flicks a Lovefilm exclusive and 1,399 movies that are Netflix-only. Oric also tapped into the catalogs' release dates, with Lovefilm housing substantially more (777) pre-80's films. Netflix, with a smaller number of titles in total, has more recent titles, with 41 coming from last year, compared to 18 on Lovefilm Instant.

However, bigger than the discrepancies between each service is the fact that the UK offerings remain tiny in comparison to their Atlantic cousins. Amazon Prime subscribers in the US get 13,185 movies and 2,204 TV seasons, compared to 3,284 and 589, respectively. So much for the special relationship.

Green Home in Washington, D.C., is Really ... - AOL Real Estate


Jay-Z once rapped lyrical about the perks of "all black everything" (from his clothes to his cars to his house), but we think this house got the wrong memo -- or color, rather. With its living room decked out from top to bottom in green (velvet, no less!), this $1.95 million Washington, D.C., home is like nothing we've ever seen.

Though the listing boasts that it's an "innovative design" that's "right out of a James Bond film" (really?), we think it's one of the craziest houses we've ever laid eyes on. Granted, it's spacious (8,500 square feet) and has an interior elevator and lovely 16-foot-high ceilings, but that green just won't do. Maybe red? Andrea Paro of Redfin has the listing. This has made it extremely difficult for past Governments to make any budgetary allocation to the Industry. This has led to what some people believe to be a neglect of the Industry.

The Musicians Union of Ghana, MUSIGA is spearheading a research to know the contribution of music to Ghana?s GDP. This project, which was launched in Accra last December witnessed an open Stakeholders Forum at the auditorium of the British Council in Accra on Tuesday January 15th 2013.

The Forum, which was chaired by Honorable Mike Gizo, aka, Nene Nagai Kassah, Chief of Agomeda and a onetime Minister of Tourism witnessed the presence of Honorable Akua Sena Dansoa, Minister of Tourism, renowned Ethnomusicologist Prof Emeritus Nketiah, one time MUSIGA President Agya Koo Nimo, Prof John Collins of the University of Ghana, Korkor Amarteifio of the Institute of Music Development, Theresa Ayoade of Charter House, the current MUSIGA President and Executives, Media people and representatives from other Creative Art Associations as well as Representatives from KPMG, the Consultants, Ministry of Chieftaincy and Culture and NDPC. Stephanie Soleansky of the French Embassy was also present.

In his statement, Bice Osei Kuffour, MUSIGA President outlined some of the problems associated with the music industry, why the research was commissioned and gave an overview of what the findings will signify. He expressed his profound gratitude to the Government of Ghana, Dr Kofi Amoah of Citizen Kofi and the World Bank for supporting this research project in particular and MUSIGA. Honorable Sena Dansoa also spoke about how her sector Ministry is in collaborations with the French Embassy to help develop the creative Arts Sector.

The Representative from NDPC gave a general briefing of how such research and data helps in informing government decision to allocate monies to the sector and how much money to allocate when the need arises. The reason why the Industry has not gotten much in terms of Government support over the years has simply being because there has not been any data to help in informing such decisions. He advised the creative Industry in general to come up with a strategic plan so as to attract funding from Government.

The KPMG Representative, Evans Asare, gave an overview of the areas the research will cover, how they intend to gather the data and when they will present a draft of their findings. This will be in three months time.? He also spoke about the general findings the research will come out with and some of the questions the research will seek to answer.

There was an open forum where participants were broken into four groups. They held discussions on some of the problems they are facing in their various sectors. All the groups joined again and discussed their findings. This was moderated by Korkor Amarteyfio. US economic hopes give markets a lift

LONDON (AP) ? A run of upbeat U.S. economic indicators helped shore up sentiment in the markets Thursday despite disappointing earnings from Bank of America and Citigroup.

As has been the case for much of this year, the U.S. was main focus of attention in markets. Relief that lawmakers agreed to a budget deal that prevented tax increases and spending cuts at the start of the year had helped many stock indexes around the world to advance to multiyear highs.

However, that momentum ground to a halt this week as investors wondered whether there was any upside, particularly in the value of stocks.

The positive U.S. economic data Thursday suggested there may be. Weekly jobless claims fell 37,000 to 335,000, their lowest level in five years, while a gauge of the housing market reinforced the view that the sector is on the mend after years of decline. Housing starts jumped a monthly 12.1 percent to an annualized rate of 954,000, their highest since June 2008.

As a result, a trading session that had been marked by a lack of momentum burst into life.

In Europe, the FTSE 100 index of leading British shares rose 0.5 percent to close at 6,132.36 while Germany's DAX rose 0.6 percent to 7,735.46. The CAC-40 in France was 1 percent higher at 3,744.11.

On Wall Street, the Dow Jones industrial average rose 0.6 percent to 13,585.25 while the broader S&P 500 index rose 0.5 percent to 1,479.91. Worse than expected results from Bank of America and Citigroup did little to alter the prevailing mood.

Andrew Wilkinson, chief economic strategist at Miller Tabak & Co., said the housing figures, in particular, raise confidence that "a spreading recovery will overflow into broader consumption habits and further permeate the economy."

If the U.S. economy, the world's largest, enjoys such an outturn, that would be a boon to the global recovery, and potentially ease some of the problems that exist elsewhere, not least in Europe.

"We think the economy is set for a great 2013 and the stock market looks set to break higher," said Wilkinson.

It's not all clear for the U.S. economy, though. Another looming battle in Congress over raising the U.S. debt ceiling is on the cards. Fitch has already warned that it may strip the U.S. of its triple A rating if there's a delay in raising it.

Earlier in Asia, Japan's Nikkei 225 index swung between gains and losses before closing nearly 0.1 percent higher at 10,609.64. On Wednesday, the Nikkei slid around 2.6 percent after investors interpreted comments from economy minister Akira Amari as suggesting he was concerned over the sharp fall in the yen in recent weeks.

"That misunderstanding has been cleared up by Amari, who clarified that he meant that the yen is still in the process of correcting back into line with fundamentals," said Lee Hardman, currency analyst at the Bank of Tokyo-Mitsubishi UFJ.

The impact of his comments on the yen was short-lived, with the dollar up 1.3 percent at 89.57 yen on Thursday. Elsewhere, the euro was 0.4 percent higher at $1.3344.

South Korea's Kospi fell almost 0.2 percent to 1,974.27 while Hong Kong's Hang Seng changed direction after posting morning gains, slipping 0.1 percent to 23,339.76. Mainland China's Shanghai Composite Index fell 1.1 percent to 2,284.91 ahead of Friday's economic growth figures, which could provide broader direction across markets on the last day of the week.

Oil prices followed equities higher, with the benchmark New York contract up $1.19 at $95.43 per barrel in electronic trading on the New York Mercantile Exchange.

Turbulence injures three on American Eagle flight

Passengers on an American Eagle flight on Wednesday suffered injuries from?turbulence, fire officials in Chicago said.

Three passengers on board American Eagle Flight 3720 complained of head injuries and one was transported to the hospital, the Chicago Fire Department said on its official media Twitter account. The two other patients refused treatment, fire officials said.

The flight, en route from New Orleans, had 26 passengers and four crew members onboard when it hit turbulence while descending from 31,000 feet to 29,000 feet, American Airlines spokeswoman Mary Frances Fagan told NBC News. The seatbelt sign was illuminated, the airline said.

American Eagle is a regional carrier that operates flights for American Airlines.

The jet, a Bombardier CRJ-700, landed without incident at Chicago's O'Hare International?at 9:31 a.m. local time, the airline said.

IT looked as though he was finally behaving like someone who had, well, won the election. That was the impression of Washington pundits and insiders who were watching President Barack Obama during his last press conference of his first term in office on Monday, a week before he is scheduled to be inaugurated as president and start serving four more years in the White House.

Gone was Mr Nice Guy and the pledges he had made after his 2008 election to become a post-partisanship president and to work together with the Republican opposition to fashion a common national policy agenda. After four years, during which the Republicans threw everything except the kitchen sink at him - implying that he was born in Kenya and was a secret Muslim, accusing him of being "un-American" and "socialist", and most important, rejecting all his overtures to them to make deals with him over fiscal policy, health-care reform, immigration, and climate change - President Obama was clearly not in a mood for a romance with the Republican lawmakers who still control the House of Representatives. In fact, he seemed to be looking to pick a fight with them.

Indeed, Mr Obama insisted during the news conference that he would not negotiate with the Republicans over the US$16.4 trillion federal debt ceiling that Congress will have to lift in the next few weeks or face the risk of the US being forced to default on its debt.

Mr Obama charged that by demanding spending cuts in exchange for agreeing to raise the federal debt ceiling, the Republicans were threatening to hold "a gun at the head of the American people" and vowed that he would not play that game as he did in summer of 2011 when the Congressional Republicans did extract from him major concessions on spending as part of a deal to raise the government's borrowing limit. Not again!, pledged the president.
